These Terms of Service ("Terms") are a legal agreement between you and FleetScout ("FleetScout", "we", "us") and govern your access to and use of our website, AI dashcam and fleet-safety control panel (together, the "Services"). By accessing or using the Services you agree to these Terms. If you are agreeing on behalf of an organisation, you confirm you have authority to bind that organisation.
FleetScout provides hardware and software to monitor driver safety, including road-facing ADAS, in-cab driver monitoring (DMS), GPS, and a control panel for analytics, alerts, reporting and coaching. We may update, improve or change the Services over time.
Access to the control panel requires an authorised account. You are responsible for keeping your credentials confidential, for all activity under your account, and for notifying us promptly of any unauthorised use. We may suspend or revoke access that we reasonably believe is unauthorised or unsafe.
FleetScout and its licensors own all rights in the Services, including software, models, designs and trademarks. We grant you a limited, non-exclusive, non-transferable right to use the Services during your subscription. You retain ownership of your own data, and grant us the rights needed to operate the Services and provide them to you.
Our handling of personal data is described in our Privacy Policy. For fleet and driver data, you are the data controller and FleetScout is the processor; you are responsible for the lawful basis of any driver monitoring you enable.
The Services are a decision-support and monitoring tool. They assist with identifying risk but do not control the vehicle and do not guarantee the prevention of fatigue, distraction, collisions or other incidents. The Services are not a substitute for safe driving, proper supervision, or compliance with road and workplace safety laws. You remain responsible for the safe operation of your fleet.
The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that detections will be complete or accurate in every case.
To the maximum extent permitted by law, FleetScout will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill. Our total liability arising out of or relating to the Services will not exceed the amounts paid by you to us for the Services in the twelve months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be excluded by law.
You agree to indemnify and hold FleetScout harmless from claims, damages and costs arising from your misuse of the Services, your breach of these Terms, or your failure to obtain any required driver notices or consents.
These Terms apply while you use the Services. We may suspend or terminate access for breach of these Terms or to protect the Services, people or property. On termination, your right to use the Services ends. Provisions that by their nature should survive (including sections 4 to 9) will survive.
We may update these Terms from time to time. The revised version will be posted here with an updated date. Continued use of the Services after changes take effect constitutes acceptance.
These Terms are governed by the laws of the jurisdiction in which FleetScout is established, without regard to conflict-of-laws rules. The courts of that jurisdiction will have exclusive jurisdiction over disputes, subject to any mandatory consumer protections that apply to you.
